Преамбула
Україна та Сполучені Штати Америки:
- Підтверджують важливість наших відносин як друзів та стратегічних партнерів. Ми маємо намір поглиблювати партнерство на благо наших народів та розширювати співробітництво з широкого спектру спільних пріоритетів.
- Наголошують, що співробітництво між двома демократичними державами ґрунтується на спільних цінностях та інтересах. Це включає поширення демократії та економічної свободи, захист безпеки та територіальної цілісності, забезпечення верховенства права, підтримку інновацій і технічного прогресу.
- Підкреслюють взаємне прагнення посилити двосторонні відносини в економічній, політичній, дипломатичній, культурній та безпековій сферах;
- Підтверджують важливість гарантій безпеки, закріплених в Тристоронній заяві Президентів США, Російської Федерації та України від 14 січня 1994 року, та Будапештського меморандуму про гарантії безпеки у зв’язку з приєднанням України до Договору про нерозповсюдження ядерної зброї від 5 грудня 1994 року.
- Підтверджують Пріоритети співробітництва Україна – США (Дорожня карта) від 31 березня 2008 року та відданість стратегічному партнерству, проголошеному Президентами В.Ющенком та Дж.Бушем 4 квітня 2005 року.
Розділ I. Принципи співробітництва
Цей рамковий документ оснований на ключових принципах та переконаннях, які поділяють обидві сторони:
- Підтримка суверенітету, незалежності, територіальної цілісності й непорушності кордонів одне одного складає основу двосторонніх відносин.
- Основою нашої дружби є взаємне розуміння та визнання того, що демократія є головною гарантією безпеки, процвітання та свободи.
- Співробітництво між демократичними державами в галузі оборони та безпеки є суттєвим для надання ефективної відповіді на загрози мирові та безпеці.
- Сильна, незалежна та демократична Україна, здатна до відповідального самозахисту, є внеском у безпеку та процвітання не лише народу України, а й Європи, яка є єдиною, вільною та живе у мирі.
Розділ II: Співробітництво у сфері оборони та безпеки
Україна та Сполучені Штати Америки поділяють життєву зацікавленість у сильній, незалежній та демократичній Україні. Поглиблення інтеграції України до євроатлантичних структур є спільним пріоритетом. Ми плануємо реалізувати програму посиленого безпекового співробітництва, яка передбачає збільшення українських можливостей та посилення України як кандидата на членство в НАТО.
- Керуючись Декларацією Північноатлантичної Ради на Бухарестському саміті НАТО від 3 квітня 2008 року та Спільною заявою Комісії Україна-НАТО від 4 квітня 2008 року, в якій закріплено, що Україна стане членом НАТО.
- Визнаючи постійне існування загроз глобальному миру та стабільності, Україна та Сполучені Штати Америки мають намір розширити рівень нинішніх програм співробітництва та допомоги з оборонних та безпекових питань з метою подолання цих загроз та поглиблення миру і стабільності. Партнерство в галузі оборони та безпеки між Україною та Сполученими Штатами Америки є вигідним як для обох країн, так і для регіону.
- Співпрацюючи в рамках Комісії Україна-НАТО, ми маємо на меті досягнення згоди стосовно структурованого плану щодо збільшення взаємосумісності та координації можливостей між Україною та НАТО, включаючи поглиблену підготовку та оснащення для Українських збройних сил.
- Визнаючи зростаючу загрозу розповсюдження зброї масового знищення, Україна та Сполучені Штати Америки зобов’язуються боротися з розповсюдженням зброї масового знищення та небезпечних технологій шляхом дотримання міжнародних стандартів нерозповсюдження та ефективної реалізації і посилення режиму експортного контролю.
Розділ III. Економічне, торговельне та енергетичне співробітництво
Україна та США мають наміри розширити співробітництво з метою сприяння створенню робочих місць, економічному зростанню, підтримки реформ та лібералізації економіки, розвитку сприятливого для торгівлі та інвестицій бізнес-клімату і удосконалення доступу на ринки товарів та послуг. Визнаючи, що торгівля є важливою для глобального економічного зростання, розвитку, свободи і процвітання, Україна і Сполучені Штати Америки підтримують такі ініціативи:
- Вітаючи вступ України 16 травня 2008 року до Світової організації торгівлі, сторони провели перше засідання Ради з питань торгівлі й інвестицій Україна – США 2 жовтня 2008 року в м. Київ. Як було обговорено в ході засідання, США продовжують підтримувати кроки України по виконанню зобов’язань в рамках СОТ. Інші напрями, де планується активізувати спільні зусилля, включають розширення доступу до ринку, розв’язання невирішених суперечок та сприяння захисту прав інтелектуальної власності. Відзначаючи важливість збільшення обсягів інвестицій для економічного зростання та розвитку, США підтримують зусилля України щодо посилення захисту інвесторів.
- Визнаючи важливість ефективно функціонуючого енергетичного сектору, сторони планують тісно співпрацювати над відбудовою і модернізацією потужностей української газотранспортної інфраструктури, диверсифікацією та убезпеченням українських джерел ядерного палива, що зменшить залежність України від іноземних джерел ядерного палива та потужностей для їх збереження.
- На розвиток Дорожньої карти пріоритетів українсько-американського співробітництва Україна та США мають намір започаткувати діяльність двосторонньої групи з питань енергетики. У відповідності до Декларації Самміту США-ЄС від 10 червня 2008 року Україна та США мають намір поглибити тристоронній діалог з Європейським Союзом щодо посиленої енергетичної безпеки.
- Активно розвиваючи співробітництво з регіонами України, включаючи Крим, США підтримують плани України щодо зміцнення безпеки, демократії та підвищення благополуччя шляхом посиленого економічного розвитку, енергозбереження, забезпечення безпеки продуктів харчування та ініціатив щодо ефективності державного управління. Україна та США мають намір співпрацювати також у сфері партнерства між державними і приватними секторами в регіонах України, спрямованого на підтримку малого та середнього бізнесу.
Розділ IV. Зміцнення демократії
Зміцнення верховенства права, просування реформи правової системи й правоохоронних органів, боротьба з корупцією мають ключове значення для добробуту України. Ми маємо наміри співпрацювати на підтримку реформ, демократії, толерантності та поваги до усіх спільнот.
- Україна та США активізують співпрацю для зміцнення судової системи, підвищення професіоналізму, відкритості та незалежності разом з покращенням правової освіти та доступу до правосуддя для усіх українців.
- Шляхом покращення взаємодії правоохоронних органів і судової влади Україна та США планують протидіяти спільним транснаціональним кримінальним загрозам – тероризму, організованій злочинності, торгівлі людьми та контрабанді наркотичних засобів, відмиванню грошей та кіберзлочинності.
- Визнаючи важливість боротьби з корупцією, Україна та США мають намір поглибити співпрацю з метою збільшення контролю з боку громадськості та засобів масової інформації антикорупційних заходів, забезпечити дотримання етичних стандартів шляхом утворення підрозділів із внутрішніх розслідувань та удосконалення урядового регулятивного процесу.
- Україна та США планують співпрацювати з метою реформування законотворчого процесу в Україні шляхом підвищення транспарентності, посилення підзвітності завдяки доступу громадськості та ЗМІ, а також поширенню інформації серед населення про діяльність Парламенту України.
- Визнаючи важливість гармонізації системи кримінального судочинства України з Європейськими та іншими міжнародними стандартами, ми плануємо більш інтенсивно працювати разом над питаннями першочергового значення, включаючи прийняття Кримінально-процесуального кодексу, який відповідатиме стандартам Ради Європи.
- США мають наміри надавати подальшу технічну допомогу Україні для підтримання зусиль українських органів виконавчої та судової влади у боротьбі з торгівлею людьми, включаючи посилення системи захисту свідків.
- Сполучені Штати Америки підтримують збільшення допомоги на здійснення демократичних перетворень та ефективного державного управління з метою продовження Україною політичного прогресу та відданості демократичному розвитку.
Розділ V. Активізація контактів між людьми та культурних обмінів
Україна та Сполучені Штати Америки поділяють бажання збільшити контакти між нашими народами та розширити наші культурні, освітні і професійні програми обмінів, що сприяють просуванню демократії та демократичних цінностей, досягненню більшого взаєморозуміння.
- Визнаючи особливу важливість активізації контактів між народами України та Сполучених Штатів Америки, сторони мають намір і надалі сприяти культурним та соціальним обмінам та діяльності в рамках таких ініціатив, як Програма Фулбрайта, Програма обмінів для майбутніх лідерів (FLEX), студентські обміни (UGRAD), Науково-практична програма з питань законодавства (LEAP), Програма відвідання для міжнародних лідерів, Програма з викладання та вивчення англійської мови, Програма „Відкритий світ”.
- Наголошуючи на необхідності нових ідей та динамізму для майбутнього наших двох країн, Україна та США мають намір розвивати поглиблене співробітництво у сфері вищої освіти та наукових досліджень. США сприятимуть таким обмінам, щоб, відповідно до законодавства та процедур США, надавати можливість особам, які відповідають установленим критеріям, брати участь у культурних, освітніх та наукових заходах.
- Наші країни продовжуватимуть тісно співпрацювати в контексті вшанування пам’яті жертв та збільшення обізнаності громадськості про Великий Голод (Голодомор) в Україні 1932-33 рр.
- Україна вітає намір США започаткувати американську дипломатичну присутність (американський представницький офіс) в місті Сімферополь.

Agreed Facilities and Areas
The Government of the United States of America (the “United States”) and the Government ofthe Slovak Republic (“Slovakia”), hereinafter referred to collectively as “the Parties” and individually as a “Party”,
Desiring to conclude an agreement on the enhanced defense cooperation between the United States and Slovakia;
Affirming that such cooperation is based on full respect for the sovereignty ofeach Party and for the mutual obligations ofthe Parties resulting from other international agreements, including the United Nations Charter;
Cognizant ofthe rights and obligations deriving from the North Atlantic Treaty, signed at Washington on April 4, 1949;
Acknowledging that the presence of United States (“U.S.”) forces in the Euro-Atlantic area contributes to strengthening the security and stability of Slovakia and the region;
Considering that U.S. forces, their dependents, and U.S. contractors may be present in the territory o f Slovakia and that the purpose o f such presence o f U.S. forces is to further the efforts of the Parties to promote peace and security in areas of mutual interest and benefit and to take part in common defense efforts;
Recognizing that the presence ofU.S. forces in the territory ofSlovakia is with the consent ofSlovakia and with full respect for the Constitution ofthe Slovak Republic and other Slovak law;
Desiring to share the responsibility of supporting those U.S. forces that may be present in the territory of Slovakia in an equitable and sustainable manner;
Recognizing the Agreement Between the Parties to the North Atlantic Treaty Regarding the Status of Their Forces, signed at London June 19, 1951 (the “NATO SOFA”), which entered into force August 23, 1953, including its provision regarding separate arrangements supplementary to the NA TO SOFA;
Recognizing the Acquisition and Cross Servicing Agreement Between the Department o f Defense ofthe United States ofAmerica and the Ministry ofDefense ofthe Slovak Republic, signed at Bratislava December 15, 1998 (the “A.CSA”), which entered into force December 15, 1998;
Recognizing the Agreement Betweenthe Government ofthe United States ofAmerica and the Government of the Slovak Republic Concerning Security Measures for the Protection of Classified Military Information, signed at Washington April 11, 1995 (the ” Information Security Agreement”), which entered into force April 11, 1995; and
Recognizing the need to enhance their common security, to contribute to international peace and stability, and to deepen cooperation in the areas ofdefense and security;
Have agreed as follows:
ARTICLE 1
SCOPE, PURPOSE, AND IMPLEMENTATION
1. This Agreement, promotes and strengthens, inter alia:
(a) Cooperation between the Parties in defense related matters, including bilaterally and in the
framework of NA TO;
(b) Defense capability development, defense planning, and military training ofthe Parties to enhance common defense efforts;
(c) Regular consultation on threats and challenges to international peace and security; and
(d) Exchange of information and experiences on strategic defense and security issues.
2. This Agreement sets forth the framework for enhanced partnership and defense and security cooperation between the United States and Slovakia and supplements the terms and conditions set forth in the NATO SOFA that govern the presence of U.S. forces and their dependents in the territory o f Slovakia and, in specific situations indicated herein, the presence and activities o f U.S. contractors in the territory of Slovakia.
3. The Parties or their Executive Agents shall consult as necessary, but no less than annually, to ensure the proper implementation of this Agreement, including with regard to the details of the activities ofU.S. forces in the territory ofSlovakia. The Executive Agents shall develop procedures for consultation between their respective representatives on all matters concerning theeffectiveimplementationofthisAgreement. Asappropriate,thePartiesortheirExecutive Agents may enter into implementing agreements or arrangements to carry out the provisions of this Agreement.
ARTICLE2 DEFINITIONS
For purposes ofthis Agreement, the following terms are hereunder defined:
1. “U.S. forces” means the entity comprising the force and the civilian component, and all property, official U.S. information, equipment, and materiel (including vehicles, vessels, and aircraft operated by or for the United States) of the U.S. Armed Forces present in the territory of Slovakia.
2. “Force” has the meaning set forth in A1ticle I, Paragraph l(a), of the NA TO SOFA.
3. Except as otherwise provided in Article 15 of this Agreement, “civilian component” has the meaning set forth in Article I, Paragraph 1(b), of the NATO SOFA, and also includes: a) employees of non-Slovak, non-commercial organizations who are nationals of the United States of America or ordinarily resident in the territory ofthe United States and who are not ordinarily resident in the territory ofthe Slovakia, and who, solely for the purpose ofcontributing to the welfare, morale, or education of U.S. forces, are accompanying those forces in the territory of Slovakia; and b) dependents employed by U.S. forces, including for the purposes ofthe military service activities contemplated in Articles 21 and 22 ofthis Agreement, and by the non commercial organizations referred to in this Paragraph.
4. “U.S. contractors” means non-Slovak individuals, non-Slovak legal entities, and their employees who are not nationals of Slovakia that are under contract or subcontract to the U.S. Department of Defense.
5. “Dependent” has the meaning set forth in Atticle I, Paragraph l(c), ofthe NATO SOFA, and also includes a family member of a member ofthe force or the civilian component who (a) is financially, legally, or for reasons of health dependent upon and supported by such member; (b) shares the quarters occupied by such member; and (c) is present in the territory ofSlovakia with the consent ofthe authorities ofthe force.
6. “Agreed Facilities and Areas” means the facilities and areas in the territory of Slovakia listed in Annex A to this Agreement, and such other facilities and areas in the territory of Slovakia as may be provided by Slovakia in the future and mutually agreed, to which U.S. forces, U.S. contractors, dependents, and others as mutually agreed, shall have the rights ofaccess and use pursuanttothisAgreement. WithfullrespectforportionsdesignatedbySlovakiaorits Executive Agent for its exclusive use, the Parties shall have joint access to and use o f Agreed Facilities and Areas, except for any portions thereof specifically designated by the Parties or their Executive Agents for the exclusive access and use o f U.S. forces.
7. “Executive Agent” means the U.S. Department of Defense for the United States and the Ministry ofDefence ofthe Slovak Republic for Slovakia, or their respective designees.
8. “Official U.S. Information” means information that is owned by, produced for or by, or is subject to the control o f the United States.
ARTICLE3
ACCESS TO AND USE OF AGREED FACILITIES AND AREAS
1. With full respect for the sovereignty and laws of the Slovak Republic, U.S. forces are authorized operational control ofAgreed Facilities and Areas for the purposes ofaccess and use by U.S. forces, U.S. contractors, dependents, and others as mutually agreed for visits; training; exercises; maneuvers; transit; support and related activities; refueling ofaircraft; bunkering of vessels; landing and recovery ofaircraft; temporary maintenance ofvehicles, vessels, and aircraft; accommodation ofpersonnel; communications; staging and deploying offorces and materiel; prepositioning of equipment, supplies, and materiel; security assistance and cooperation activities; joint and combined training activities; humanitarian and disaster reliefactivities; contingency operations; construction in support ofmutually agreed activities; and such other purposes as the Parties or their Executive Agents may agree, including those undertaken in the framework of the North Atlantic Treaty.
2. In furtherance of such activities and purposes, Slovakia authorizes U.S. forces to control entry to Agreed Facilities and Areas, or portions thereof, that have been provided for exclusive use by U.S. forces, and to coordinate entry with Slovak authorities at Agreed Facilities and Areas jointly usedbyU.S.forcesandSlovakArmedForces,forpurposesofsafetyandsecurity. The Executive Agents shall establish procedures to cooperate regarding operational and security concerns for access to Agreed Facilities and Areas.
3. When requested, the Slovak Executive Agent shall facilitate temporary access and use by U.S . forces and U.S. contractors to:
(a) public land and facilities (including roads, ports, and airports) that are not a part ofan Agreed Facility and Area, including those owned or controlled by Slovakia, by local self governing regions, or by local governments, and
(b) private land and facilities (including roads, ports, and airports) for use in support ofU.S. forces .
Such facilitation shall be without cost to U.S. forces or U.S. contractors.
4. In making Agreed Facilities and Areas available and in the use of such Agreed Facilities and Areas, the Parties shall give due regard to operational and security concerns.
5. Slovakia shall provide, without rental or similar costs to U.S. forces, all Agreed Facilities and Areas, including those jointly used by U.S. forces and Slovak Armed Forces.
6. In coordination with the Slovak Executive Agent, U.S. forces and U.S. contractors may undertake construction activities on, and make alterations and improvements to, Agreed Facilities and Areas in furtherance ofthe activities and purposes set forth in Paragraph 1ofthis Article. U.S.forcesshallcooperatewiththeSlovakExecutiveAgentonissuesregardingsuch construction, alterations, and improvements based on the Parties’ shared intent that the technical requirements and construction standards ofany such projects undertaken by or on behalfofU.S. forcesshouldbeconsistentwiththerequirementsandstandardsofbothParties. Towardsthis
end, this Paragraph shall be implemented in accordance with mutually determined procedures, includinginimplementingarrangementsifnecessary. U.S.forcesmaycarryoutsuch construction, alterations, and improvements with members ofthe force.
7. U.S. forces shall be responsible for the construction and development costs for Agreed Facilities and Areas provided for the exclusive use of U.S. forces, and for the operations and maintenance costs thereof, unless otherwise mutually determined.
8. ThePartiesshallberesponsibleonthebasisofproportionateusefortheconstructionand development costs and operations and maintenance costs o f Agreed Facilities and Areas provided for joint use, or otherwise used jointly by U.S. forces and Slovak Armed Forces, unless otherwise mutually determined.
9. Funding ofconstruction projects undertaken by U.S. forces shall be in accordance with U.S. laws and regulations.
10. The Slovak Executive Agent shall facilitate the efforts ofU.S. forces in these undertakings by obtaining the necessary Slovak authorizations and permits for such construction, alterations, and improvements, performed by or on behalfof U.S. forces. U.S. forces or U.S. contractors shall provide, when requested by the Slovak Executive Agent, all relevant, necessary, and releasable documentation to obtain such authorizations and permits. Such authorizations and permits shall be issued without cost to U.S. forces or U.S. contractors.
11. The Parties or their Executive Agents, as appropriate, shall cooperate on planning regarding the use and development of Agreed Facilities and Areas as well as areas surrounding Agreed Facilities and Areas to ensure the implementation ofthis Agreement over the long term.
ARTICLE 4 PREPOSITIONING OF DEFENSE EQUIPMENT, SUPPLIES, AND MA TERIEL
I. With full respect for the sovereignty and laws of the Slovak Republic, U.S. forces may transport, preposition, and store defense equipment, supplies, and materiel (“prepositioned materiel”) at Agreed Facilities and Areas, and at other locations as mutually agreed. The Parties or their Executive Agents shall consult, as necessary, concerning activities under this Article.
2. U.S.forcesshallnotify,inadvance,theSlovakExecutiveAgentregardingthetypes, quantities, and delivery schedules of such prepositioned materiel that U.S. forces intend to transport or preposition in the territory ofSlovakia, as well as regarding U.S. contractors who make such deliveries.
3. The prepositioned materiel ofU.S. forces and the facilities or portions thereof designated for storage of such prepositioned materiel shall be for the exclusive use of U.S. forces. U.S. forces shall have exclusive control over the access to, use of, and disposition of such prepositioned materiel and shall have the unencumbered right to remove such prepositioned materiel at any time from the territory of Slovakia.
4. U.S. forces and U.S. contractors shall have operational control ofstorage facilities referenced in Paragraph l of this Article for matters related to the prepositioning and storage of prepositioned materiel, including delivery, management, inspection, use, maintenance, and removalofsuchprepositionedmateriel. Aircraft,vehicles,andvesselsoperatedbyorforU.S. forces shall have access to airports and inland ports of Slovakia and other locations, as agreed, for the delivery to, storage and maintenance in, and removal from the territory of Slovakia of U.S. forces’ prepositioned materiel.
ARTICLES PROPERTY OWNERSHIP
1. All buildings, non-relocatable structures, and assemblies affixed to the land in Agreed Facilities and Areas, including those altered or improved by U.S. forces, shall remain the property of Slovakia. All such buildings, structures, and assemblies constructed by U.S. forces shall become the property ofSlovakia, once constructed, but shall be used by U.S. forces until no longer needed by U.S. forces.
2. U .S. forces shall return as the sole and unencumbered property o f Slovakia any Agreed Facility or Area, or any portion thereof, including buildings, non-relocatable structures, and assemblies constructed by U.S. forces once no longer used by U.S. forces, provided that the United States shall incur no expense to do so. The Parties or their Executive Agents shall consult regarding the terms of return of any Agreed Facility or Area, including compensation for the mutually determined residual value of improvements or construction made by the United States.
3. U.S. forces and U.S. contractors shall retain title to all equipment, materiel, supplies, relocatable structures, and other movable property they have imported into or acquired within the territory of Slovakia in connection with this Agreement unless and until such time as they smTender title.
4. The Parties or their designees may consult regarding the possible transfer or purchase ofU.S. forces’ equipment determined to be excess to the needs ofthe United States, as may be authorized by U.S. laws and regulations.
ARTICLE6 SECU RITY
1. Understanding that Slovakia has overall responsibility for security in the territory of Slovakia, Slovakia shall take such measures as are necessary to ensure the protection, safety, and security ofU.S. forces, U.S. contractors, dependents, and prepositioned materiel, and the protection and security ofOfficial U.S. Information. In furtherance ofthis responsibility, Slovak and U.S. forces authorities shall coordinate closely to ensure that security and protection is provided.
2. U.S. forces are authorized to exercise all rights and authorities necessary for U.S. forces’ operational control for the purpose of their access and use of Agreed Facilities and Areas, including taking appropriate measures to defend, maintain, or restore order, and to protect U.S. forces, U.S. contractors, and dependents. The United States should coordinate such measures and shall coordinate force protection plans with the appropriate authorities ofSlovakia.
ARTICLE 7 ENTRY AND EXIT
I. SlovakiashallnotrequirecountersignatureofmovementordersunderArticleIII,Paragraph 2(b), ofthe NATO SOFA.
2. InaccordancewiththeNATOSOFA,Slovakiashallnotrequirepassportsorvisasforentry into and departures from the territory of Slovakia for members of the force holding the required personal identity card and a valid movement order. Further, Slovakia shall not require visas for entry into and departure from the territory of Slovakia for members ofthe civilian component, dependents, and U.S. contractors holding a U.S. Department ofDefense identification card, movement order, or letter ofauthorization issued by the competent authority ofthe United States confirming their status, and a valid passport.
3. U.S. forces, U.S. contractors, and dependents shall be exempt from regulations governing the registrationandcontrolofaliens. TheirstayintheterritoryofSlovakiashallbeconsidereda temporarystay. UpontherequestofU.S.forcesauthorities,Slovakauthoritiesshallissue,free ofcharge, a certificate ofstay for these persons.
4. ShouldamemberoftheU.S.forcesdieorleavetheterritoryofSlovakiaontransfer,the dependents of such member shall continue to be accorded the status of dependents under this Agreement for a period ofninety (90) days after such death or transfer. In cases where dependent children are enrolled in education facilities in the territory of Slovakia prior to the member’s death or transfer, the dependents shall continue to be accorded the status of dependents for a period ofnot less than thirty (30) calendar days after the end ofthe school year or termination ofenrollment.
ARTICLES LOGISTICS SUPPORT
1. Slovakia shall use best efforts, considering its internal national requirements and available capabilities, to provide to U.S. forces, upon request, logistics support to conduct activities under this Agreement.
2. As appropriate, such logistics support shall be provided, and reimbursement made, in accordance with the ACSA or successor agreements.
3. For any logistic support not addressed by Paragraph 2 ofthis Article, U.S. forces and U.S. contractorsshallpayreasonablecostsforlogisticssupportrequestedandreceived. Inthis regard, Slovakia shall accord to U.S. forces treatment no less favorable than is accorded to the Slovak Armed Forces, less taxes, fees, or similar charges, in accordance with mutually determined procedures.
ARTICLE 9 MOTOR VEHICLES
I. Slovak authorities shall honor the registration and licensing by U.S. military and civilian authorities of motor vehicles and trailers, including those privately-owned or operated, of U.S. forces, including members of the force and the civilian component, U.S. contractors, and dependents. Upon the request ofU.S. forces authorities, Slovak authorities shall issue, without charge, military license plates for U.S. forces’ official, non-tactical vehicles, and license plates that are indistinguishable from those issued to the Slovak population at large for private motor vehicles ofthe members ofthe U.S. forces, U.S. contractors, and dependents. Registration and licensing procedures undertaken by Slovakia referenced in this Paragraph shall be executed by the Slovak Military Police in accordance with procedures mutually determined by the Executive Agents. Such mutually detennined procedures shall be reflected in the guidelines for the Slovak Military Police.
2. U.S. forces authorities shall take adequate safety measures with respect to motor vehicles and trailers registered and licensed by them or used by U.S. forces in the territory of Slovakia.
3. It is the duty of members of the U.S. forces, U.S. contractors, and dependents to respect the law of Slovakia regarding automobile liability insurance coverage for their private motor vehicles and trailers while in the territory of Slovakia.
ARTICLE 10 LICENSES
1. A license or other permit issued by U.S. authorities to a member ofthe U.S. forces or a U.S. contractor, empowering the holder to operate vehicles, vessels, or aircraft of the force shall be valid for such operation within the territory of Slovakia.
2. Slovakauthoritiesshallacceptasvalid,withoutadrivingtestorfee,drivinglicensesissued by the United States, its States, or political subdivisions for the operation ofprivate motor vehiclesbymembersoftheU.S.forcesandtheirdependents,andU.S.contractors. International drivers’ licenses shall not be required.
3. Slovakia shall not require members of the U.S. forces or U.S. contractors to obtain professional licenses issued by Slovakia in relation to the provision ofservices provided as part oftheir official or contractual duties to U.S. forces and their dependents, or to U.S. contractors, as well as to other persons as mutually agreed.
ARTICLE 11
MOVEMENT OF AIRCRAFT, VESSELS, AND VEHICLES
1. Aircraft, vessels, and vehicles operated by or exclusively for U.S. forces may enter, exit, and move freely within the territory of Slovakia with respect for the relevant rules for safety and movement. Such aircraft, vessels, and vehicles shall be free from boarding and inspection without the consent o f the United States.
2. Aircraft operated by or exclusively for U.S. forces shall be authorized to over-fly, conduct aerial refueling, land, and take off within the territory of Slovakia. Such aircraft shall not be subject to air navigation service charges, including en route charges and terminal charges. Additionally, such aircraft shall not be subject to airport charges, including landing charges, parking charges and passenger service charges, at government-owned and operated airports in the territory of Slovakia.
3. U.S.forces,andU.S.contractorsoperatingonbehalfofU.S.forces,shallpayreasonable charges for services requested and received, at rates no less favorable than those paid by the Slovak Armed Forces less taxes and similar charges.
4. The competent authorities of the Parties shall cooperate in a manner consistent with the respect for relevant rules pursuant to Paragraph 1 ofthis Article, including as it relates to the transportation ofarms, heavy equipment, and hazardous materials within the territory of Slovakia.
ARTICLE 12 CRIMINAL JURISDICTION
l. Slovakia recognizes the particular importance of U.S. forces authorities’ disciplinary control over members of the U.S. forces and the effect that such control has on operational readiness. Therefore, at the request of the United States and in furtherance of its commitment to mutual defense, Slovakia hereby exercises its sovereign discretion to waive its primary right to exercise criminal jurisdiction as provided by Article VII, Paragraph 3(c), of the NA TO SOFA. In specific cases ofoffenses ofparticular importance to Slovakia, Slovak authorities may withdraw the waiver by providing a statement in writing to the competent U.S. forces authorities not later than thirty (30) days after receipt ofthe notification described in Paragraph 2 ofthis Article. Slovak authorities may also submit a statement prior to receipt of such notification.
2. U.S. forces shall notify the Slovak authorities of each case falling under the provisions of Paragraph 1ofthis Article, except for offenses that carry a maximum punishment ofa fine or confinement of less than (3) three years.
3. Whenever a member ofthe U.S. forces, or a dependent, is prosecuted by Slovak authorities, jurisdiction shall be exercised by Slovak civilian courts o f ordinary jurisdiction.
4. Members ofthe U.S. forces and dependents shall not be tried in absentia without their consent, unless they have wrongfully avoided appearance before the court after properly receiving notice ofthe date oftrial or they have improperly absented themselves from U.S. forces authorities.
5. Forpurposesofdeterminingwhetheranallegedcriminaloffense.hasarisenoutofanyactor omission done in the performance of official duty by a member of the U.S. forces under Article VII, Paragraph 3(a)(ii), ofthe NATO SOFA, certification by the appropriate U.S. forces authority in the territory ofthe Slovakia that such act or omission was done in the performance of official duty shall constitute conclusive proof of the fact.
6. The appropriate authorities ofthe Parties shall cooperate and exchange information, as appropriate, in order to facilitate victims’ rights, including potential victims’ claims for compensation under internal national systems.
ARTICLE 13 CUSTODY AND ACCESS
1. Slovak authorities shall notify U.S. forces authorities immediately when a member of the U.S. forces, or a dependent, is arrested or detained by Slovak authorities. U.S. forces authorities shall have prompt access, in coordination with Slovak authorities, to any such individual whenever requested. U.S. forces shall be permitted to be present during all proceedings, including interrogations of such member or dependent by Slovak authorities.
2. A member ofthe U.S. forces or a dependent under investigation or pending trial by Slovak authorities shall remain or be placed under the control ofU.S. forces authorities, ifsuch authorities so request, until the conclusion ofall related courtproceedings (including appellate proceedings). Insuchcases,U.S.forcesauthoritiesshallensuretheappearanceatsuch proceedings o f the member o f the force, and shall make best efforts to ensure the appearance o f the member of the civilian component or the dependent, before Slovak authorities in any proceedingsthatmayrequirethepresenceofsuchperson. IntheeventSlovakcourtproceedings are not completed within one (1) year oftheir commencement, U.S. forces authorities shall be relievedofanyobligationsunderthisParagraph. UponrequestofSlovakauthorities,thisperiod of time may be extended as agreed to by U.S. forces authorities and appropriate Slovak authorities. U.S. forces authorities shall give sympathetic consideration to such a request.
3. Any period oftime spent in restraint exercised by Slovak authorities or custody exercised by U.S. forces authorities shall be credited against any sentence to confinement eventually adjudged in the same case.
4. Except as otherwise agreed by the Parties, confinement imposed by a Slovak court upon a member ofthe U.S. forces, or a dependent, shall be served in one or more Slovak penal institutionsdesignatedforsuchpurposesbytheParties. SlovakauthoritiesshallpermitU.S. forces authorities to visit such persons outside of regular visiting hours and to provide such persons with assistance, including for their health, welfare, and morale, such as clothing, food, bedding, medical and dental care, and religious counseling. Slovak authorities shall permit family members to visit such persons in accordance with regular visiting hours and as also may be agreed by special arrangement, and to provide such persons with assistance, including for their health, welfare, and morale, such as clothing, food, bedding, medical and dental care, and religious counseling.
ARTICLE 14 DISCIPLINE
1. U.S. forces authorities shall be responsible for the maintenance ofdiscipline and order over U.S. forces and, for this purpose, may police the Agreed Facilities and Areas or premises where U.S. forces may otherwise be located as described in Article VII, Paragraph 10, of the NATO SOFA. In those areas jointly used by U.S. forces and Slovak Armed Forces, the relevant authorities shall coordinate regarding such policing.
2. In close coordination with the relevant Slovak authorities and recognizing that Slovakia has sovereign law enforcement responsibilities within the territory o f Slovakia, U.S. forces authorities may authorize the use ofU.S. forces military police for the maintenance ofdiscipline and order over U.S. forces in communities near military facilities and areas where U.S. forces are located .
ARTICLE 15 CLAIMS
1. Members of the U.S. forces, including the civilian component, shall not be subject to any proceedings for civil claims or administrative penalties arising out of acts or omissions attributable to such persons done in the performance oftheir official duties. Such claims may be presented to the appropriate Slovak authorities and processed according to the provisions contained in Article VIII of the NATO SOFA.
2. For purposes of this Article, the term “civilian component” shall include all persons, regardless of their nationality or place of residence, who are U.S. Government employees acting in the performance of official duty as assigned by U.S. forces, but shall not include U.S. contractors, other contractors, and employees ofthose contractors or ofnon-commercial organizations, regardless of their nationality or place ofresidence.
3. Forpurposesofdeterminingwhetherpotentialcivilliabilityhasarisenoutofanyactor omission done in the performance ofofficial duty by a member ofthe U.S. forces, including the civilian component, certification by the appropriate U.S. forces authority in Slovakia that such act or omission was done in the perfonnance of official duty shall constitute conclusive proof of the fact.
4. Members ofthe U.S. forces, including the civilian component, shall not suffer default judgments or actions prejudicial to their interests when official duties or duly authorized absences temporarily prevent their attendance at non-criminal proceedings.
ARTICLE 16 OFFICIAL T AX EXEMPTIONS
1. With respect to value added taxes (“VAT”), sales taxes, use taxes, excise taxes, or similar or successor taxes, an exemption shall apply to acquisitions by or for U.S. forces ofmateriel, supplies, services, equipment, and other property (a) acquired for the ultimate use by U.S. forces; (b) to be consumed in the performance ofa contract with or on behalf of U.S. forces; or (c) to be incorporated into articles or facilities used by U.S. forces. U.S. forces shall provide to the competent Slovak authorities an appropriate certification that such materiel, supplies, services, equipment, and other property are for U.S. forces.
2. The exemption shall be applied to acquisitions referred to in Paragraph 1 ofthis Article in accordance with mutually determined procedures set out in an implementing arrangement. The exemption shall be applied at the point ofpurchase, provided the transaction is accompanied by the appropriate certification referred to in Paragraph 1 ofthis Article. In all other cases, or in the event a vendor is unable to provide such point of purchase exemption, the exemption shall be granted by reimbursement within thirty (30) days ofreceipt of a request.
ARTICLE 17 PERSONAL TAX EXEMPTIONS
1. MembersoftheU.S.forcesanddependentsshallnotbeliabletopayanytax,includingVAT, fee, license charge, or similar charges, in the territory of Slovakia on the purchase, ownership, possession, use, transfer between themselves, or transfer in connection with death, oftheir tangible movable property imported into the territo1y of Slovakia or acquired there for their own personal use. The exemption shall apply at the point ofpurchase, iffeasible, or be reimbursed within thirty (30) days ofa request, in accordance with procedures set out in an implementing arrangement. Members ofthe U.S. forces and dependents who possess or use sound and television broadcast receiving apparatus and Internet-capable devices in the territory of Slovakia shall be exempt from taxes, fees, license charges, or similar charges related to such use or possession. Motor vehicles owned by members ofthe U.S. forces and dependents shall be exempt from Slovak road taxes, registration or license fees, and similar charges, but not from the payment oftolls for the use ofroads, bridges, and tunnels paid by members ofthe general public.
2. The exemption from taxes on income provided by Article X of the NATO SOFA shall also apply to income received by members ofthe U.S. forces, dependents, and U.S. contractors from employment with the organizations referred to in Article 2, Paragraph 3, of this Agreement, and activities addressed in Articles 21 and 22 of this Agreement, and from sources outside the territory ofSlovakia.
3. The provisions of Slovak laws and regulations pertaining to the obligation of an employer or self-employed individual to withhold or prepay income taxes and social security contributions shall not be applicable to income exempt from taxation in the territory of Slovakia.
ARTICLE 18
OFFICIAL IMPORTATION AND EXPORTATION
1. With reference to Article XI ofthe NATO SOFA, materiel, supplies, equipment, and other property (a) imported by U.S. forces; (b) which are for the ultimate use by or for U.S. forces, including to support military service activities provided for in Articles 21 and 22 ofthis Agreement; (c) which are to be used or consumed in the performance ofa contract with or on behalfofU.S. forces; or (d) which are to be incorporated into articles or facilities used by U.S. forces,shallbepermittedentryintotheterritoryofSlovakia. Suchentryshallbefreefrom duties, import or registration fees, and other similar charges, including but not limited to use taxes, excise taxes, and VAT.
2. ThePartiesshallcooperateasnecessarytoensurethatthequantitiesofmateriel,supplies, equipment, and other prope1ty imported are reasonable. U.S. forces shall provide Slovak authorities an appropriate certificate, as provided for in Article XI, Paragraph 4 of the NATO SOFA, that such materiel, supplies, equipment, and other property qualify for the exemption underthetermsofthisArticle. Depositofthecertificateshallbeacceptedinlieuofacustoms inspection by Slovak authorities ofthe items imported and exported by or for U. S. forces under thisArticle. Whenmateriel,supplies,equipment,andotherpropertyareimportedbycontractors under the terms ofthis Article, U.S. forces shall require the contractors to use the items exclusively for the execution of U.S. forces’ contracts.
3. The materiel, supplies, equipment, and other property referred to in Paragraph l of this Article shall be exempt from any tax or other charge that would otherwise be assessed upon such property after its importation or acquisition.
4. The exportation from the territory of Slovakia of the materiel, supplies, equipment, and other property referred to in Paragraph l ofthis Article shall be exempt from Slovak export duties.
ARTICLE 19
PERSONAL IMPORTATION AND EXPORTATION
I. Members ofthe U.S. forces, dependents, and U.S. contractors may import their personal effects, furniture, one (1) private motor vehicle per person eighteen (18) years or older, and other goods, excluding firearms, intended for their personal or domestic use or consumption free of customsdutyandtaxesduringtheirassignmentintheterritoryofSlovakia. Thisprivilegeshall apply not only to goods that are the property of such persons but also to goods sent to them by way ofgift or delivered to them in fulfillment ofcontracts concluded with persons not domiciled in the territory of Slovakia. Such imports may not exceed reasonable amounts for personal use and must not indicate, by their nature or quantity, that the goods are being imported for commercial reasons. Exemptions on importation offuel, tobacco products, and alcohol products shall be subject to quantitative limits as mutually determined.
2. The goods referred to in Paragraph 1ofthis Article and other goods acquired free oftaxes and/or duties may not be sold or otherwise transferred to persons in the territory of Slovakia who are not entitled to import such goods duty free, unless such transfer is approved by the appropriate Slovak authorities. Such approval shall not be required for gifts to charity. Payment ofany taxes due as the result of transactions with persons not entitled to import such goods shall be the responsibility ofthe ultimate recipient ofsuch goods. Members ofthe U.S. forces, dependents, and U.S. contractors may freely transfer property referred to in Paragraph 1 ofthis Alticlebetweenthemselvesandsuchtransfersshallbefreeoftaxand/orduty. U.S.forcesshall maintain records ofthese transfers oftax or duty free merchandise. Slovak authorities shall accept duly filed police reports as conclusive proofthat duty and tax free goods ofmembers of the U.S. forces, dependents, and U.S. contractors have been stolen, which shall relieve the individuals ofany liability for payment ofthe tax or duty.
3. Members ofthe U.S. forces, dependents, and U.S. contractors may re-export (or export) free of export duties or charges, any goods imported (or acquired) by them into the territory of Slovakia during their period ofduty.
ARTICLE 20 CUSTOMS PROCEDURES
1. Slovakia shall take all appropriate measures to ensure the smooth and rapid clearance of importsandexportscontemplatedunderthisAgreement. Anycustomsinspectionshalltake place expeditiously.
2. Customs inspections under this Agreement shall be carried out in accordance with procedures mutuallyagreedbetweentheappropriateSlovakauthoritiesandU.S.forces. Anycustoms inspection by Slovak customs authorities ofincoming or outgoing personal property ofmembers of the U.S. forces or dependents shall be conducted when the property is delivered to or picked up from the individual’s residence, or in accordance with mutually determined procedures.
3. U.S. forces’ classified information may be imported into and exported from the territory of Slovakia without being subjected to a customs inspection. “Classified information” has the meaning set forth in, and shall be handled in accordance with the terms of, the Information Security Agreement, or successor agreements.
4. U.S. forces authorities shall establish the necessary measures at facilities where U.S. forces are located to prevent abuses of the rights granted under the customs provisions of the NATO SOFA and this Agreement. U.S. forces authorities and Slovak authorities shall cooperate in the investigation of any alleged customs violations.
ARTICLE21 MILITARY SERVICE ACTIVITIES
1. U.S. forces may establish military service exchanges, commissaries, other sales outlets, open messes, social and educational centers, and recreational service areas in the territory of Slovakia at mutually agreed locations for use by members ofthe U.S. forces, dependents, and other authorized personnel as mutually agreed. U.S. forces authorities may operate and maintain the foregoing military service activities directly or through contract with other organizations. No license, permit, inspection, or other regulatory control shall be required by Slovakia for these military service activities. The Executive Agents shall cooperate regarding any concerns that may arise in connection with these activities.
2. U.S. forces may enter into contracts with financial institutions to operate banking and other financial activities in the territory of Slovakia for the exclusive use of U.S. forces, U.S. contractors, and dependents.
3. The activities and organizations referred to in this Article shall be accorded the same fiscal and customs exemptions granted to U.S. forces. Such activities and organizations shall be maintainedandoperatedinaccordancewithapplicableU.S.regulations. Suchactivitiesand organizations shall not be required to collect or pay taxes or other fees for activities related to their operations.
4. U.S. forces shall adopt appropriate measures to prevent the sale of goods and property imported into or acquired in the territory of Slovakia by the activities and organizations referred to in Paragraphs 1 and 2 ofthis Article to persons who are not authorized to patronize such activities or organizations.
ARTICLE 22 MILITARY POST OFFICES
1. The United States may establish, maintain, and operate military post offices for the purpose of collecting, transporting, and delivering postal items, as well as providing related postal services for use by U.S. forces, dependents, and U.S. contractors.
2. Mail posted at such post offices may bear U.S. stamps.
3. U.S. forces’ official mail shall be exempt from inspection, search, or seizure.
4. U.S.forcesauthoritiesshallestablishappropriateandnecessarymeasuresatmilitarypost offices to prevent the improper importation of goods into the territory of Slovakia by members of the U.S. forces, dependents, and U.S. contractors.
ARTICLE23 CURRENCY AND EXCHANGE
1. U.S. forces shall have the right to import, export, and use U.S. currency or financial instruments expressed in the currency o f the United States in any amount.
2. U.S. forces authorities may distribute to or exchange for members ofthe U.S. forces and dependents currency of, and instruments denominated in, the currency valid in:
(a) the United States o f America; (b) the Slovak Republic; and
(c) any other country
3. Members of the U.S. forces and dependents may:
(a) Import and export U.S. currency and instruments denominated in currency ofthe United States; and
(b) Export from the territory of Slovakia any currency, and instruments denominated in any such currency, provided that such U.S. forces or dependents have either imported such currency or instruments into the territory of Slovakia, or received such currency or instruments from U.S. forces.
ARTICLE 24 LABOR
1. U.S. forces and organizations conducting those military service activities described in Articles 21 and 22 of this Agreement may recruit and employ dependents, as well as persons authorized to be employed in the territory of Slovakia, and may administer those employees in accordance with this Article. Such dependents shall not be required to possess a work permit for the employment referenced in this Article.
2. Terms and conditions of employment shall be set by U.S. forces and such organizations in accordance with applicable U.S. laws and regulations, taking into consideration prevailing wages and the provisions of labor legislation of Slovakia to the degree not inconsistent with this Agreement or the military requirements ofU.S. forces. Wages and salaries, benefits, supplementary payments, and increases in such payments shall be in accordance with U.S. laws and regulations. Wages for local civilian employees shall be set after additionally taking into consideration any tax obligations ofthe employee, as well as other employee contributions and payments, including to social security, health security, and accident insurance. Employment of local civilian employees by U.S. forces shall not impose any obligations on U.S. forces with respect to Slovak social security laws.
ARTICLE 25 CONTRACTING PROCEDURES
1. U.S. forces may contract for any materiel, supplies, equipment, and services (including construction) to be furnished or undertaken in the territory of Slovakia without restriction as to choice of contractor, supplier, or person who provides such materiel, supplies, equipment, or services. Such contracts shall be solicited, awarded, and administered in accordance with U.S. laws and regulations.
2. SlovakiashallaccordtoU.S.forcestreatmentinthematterofprocurementofgoods,services, and utilities no less favorable than is accorded to the Slovak Armed Forces.
ARTICLE 26 STATUS OF CONTRACTORS
U.S. contractors shall be exempt from Slovak laws and regulations with respect to the terms and conditions of their employment to perform work under contracts with U.S. forces, and with respect to the licensing and registration o f businesses and corporations solely with regard to the provision ofgoods and services to U.S. forces in the territory of Slovakia. Such contractors also shall be exempt from all taxes, including corporate, excise, and V A T, arising solely from the delivery to U.S. forces of goods or services, or from construction of facilities for U.S. forces. Such contractors also shall not be subject to any form of income or profits tax by Slovakia or its political subdivisions on that portion ofits income or profits derived from a contract or subcontract with U.S. forces.
ARTICLE27
ENVIRONMENT, PUBLIC HEALTH, AND SAFETY
1. The Parties agree to implement this Agreement in a manner consistent with the protection of the natural environment of Slovakia and public health and safety, and to pursue a preventative rather than reactive approach to environmental protection, public health, including with regard to animal and plant disease, and safety. To this end, the competent authorities of the Parties shall consult and cooperate to ensure problems that may arise are dealt with immediately in order to prevent any lasting damage to the environment or endangerment ofpublic health and safety. The United States shall respect relevant Slovak environmental, health, and safety laws in the executionofU.S.policies. Slovakiashallimplementenvironmental,health,andsafetylaws, regulations, and standards with due regard for the health and safety o f U.S. forces, dependents, and U.S. contractors.
2. Toassistintheenvironmentallysoundmanagementofhazardouswastes,Slovakiashall designate an entity as the competent authority for the purpose ofits required notifications under the Basel Convention on the Control ofTransboundary Movements ofHazardous Wastes and Their Disposal, adopted at Basel on March 22, 1989, and any implementing legislation. U.S. forces shall provide the information required for Slovakia to comply with such obligations.
ARTICLE 28
UTILITIES AND COMMUNICATIONS
1. U.S. forces and U.S. contractors shall be allowed to use water, electricity, and other public utilities on terms and conditions, including rates or charges, no less favorable than those available to the Slovak Armed Forces or Slovakia in like circumstances, less taxes or other government fees or charges. U.S. forces’ costs shall be equal to their pro rata share ofthe use of such utilities.
2. PersonaluseofcommunalwastemanagementservicesbymembersoftheU.S.forces, dependents, and U.S. contractors remains subject to the prevailing fee for such services, as established by the relevant Slovak authorities.
3. The Parties recognize that it may be necessary for U.S. forces to use the radio spectrum. The United States shall be allowed to operate its own telecommunication systems (as “telecommunication” is defined in the 1992 Constitution and Convention of the International Telecommunication Union). This shall include the right to utilize such means and services as required to ensure full ability to operate telecommunication systems, and the right to use, the necessary radio spectrum for this purpose consistent with the coordination requirements in Paragraph 4 ofthis Article. Use ofthe radio spectrumshall be free ofcost to the United States.
4. U.S. forces, in the interest of avoiding mutually disruptive interference, shall make every reasonable effort to coordinate the use ofthe radio spectrum with the appropriate Slovak authorities, taking into account the National Table of Frequency Allocations.
5. In the event that equipment ofU.S. forces or U.S. contractors causes harmful interference with the operation of equipment in the territory of Slovakia, U.S. forces and Slovak authorities shall urgently consult in order to mitigate such interference, taking into account operational considerations.
ARTICLE 29 RESOURCING AND DISPUTES
I. All activities under this Agreement are subject to the availability ofresources and funds appropriated for these purposes.
2. Disputesshallberesolvedatthelowestlevelpossibleand,asnecessary,elevatedtothe Executive Agents for consideration and resolution. Those disputes that cannot be resolved by the Executive Agents shall be referred to the Parties for consultation and resolution, as appropriate.
3. Disputes and other matters subject to consultation under this Agreement shall not be referred to any national court, or to any international court, tribunal, or similar body or to any other third party for settlement.
ARTICLE 30
ENTRY INTO FORCE, AMENDMENT, AND DURATION
1. This Agreement shall enter into force on the first (1st) day ofthe second (2nd) month following the date o f the later note by which the Parties notify each other through diplomatic channels ofthe fulfilment oftheir respective internal legal procedures necessary for the entry into force of this Agreement.
2. This Agreement may be amended by written agreement ofthe Parties.
3. This Agreement shall have an initial term often (10) years. Afte.r the initial term, it shall continue in force, but may be terminated by either Party upon one (1) year’s written notice to the other Party through diplomatic channels.
4. Annex A to this Agreement shall form an integral part ofthis Agreement and may be amended by written agreement of the Parties or their Executive Agents.

uznavajuc, ze p6sobenie ozbrojenych sil USA na uzemi Slovenskej republiky je so suhlasom Slovenskej republiky as plnym respektovanim Ustavy Slovenskej republiky a inych slovenskych zakonov,
zelajuc si spolocne zdiel’at’ zodpovednost’ pri podpore tych ozbrojenych sfl USA, ktore mozu byt’ pritomne na uzemi Slovenskej republiky, a to spravodlivym a udrzatel’nym sp6sobom,
uznavajuc Zmluvu medzi statmi, ktore su stranami Severoatlantickej zmluvy, vzt’ahujucu sa na status ich ozbrojenych sil, podpisanu v Londyne 19. juna 1951 (d’alej len ,,NATO SOFA”), ktora nadobudla platnost’ 23. augusta 1953, vratane jej ustanovenia o samostatnych dojednaniach, ktore dopliiaju NATO SOFA,
uznavajuc Dohodu o nadobudnuti a vzajomnom poskytovani sluzieb medzi Ministerstvom obrany Spojenych statov americkych a Ministerstvom obrany Slovenskej republiky, podpisanu v Bratislave 15. decembra 1998 (d’alej len ,,ACSA”), ktora nadobudla platnost’ 15. decembra 1998,
uznavajuc Dohodu medzi vladou Spojenych statov americkych a vladou Slovenskej republiky o bezpecnostnych opatreniach na ochranu utajovanych vojenskych informacii, podpisanu vo Washingtone 11. aprila 1995 (d’alej !en ,,Dohoda o infonnacnej bezpecnosti”), ktora nadobudla platnost’ 11. aprila 1995 a
uznavajuc potrebu posilnit’ svoju spolocnu bezpecnost’, prispiet’ k medzinarodnemu mieru a stabilite a prehibit’ spolupracu v oblasti obrany a bezpecnosti,
sa dohodli takto:
CLANOK 1
PREDMET, UCEL A VYKONAVANIE
1. Ta.to Dohoda podporuje a posilfmje, inter alia:
(a) spolupracu medzi Stranami v zalezitostiach suvisiacich s obranou, vratane bilateralnej
spoluprace a spoluprace v ramci NATO,
(b) rozvoj obrannych sposobilostf, obranne planovanie a vojensky vycvik Stran na posilnenie spolocneho usilia v oblasti obrany,
(c) pravidelne konzultacie o hrozbach a vyzvach pre medzinarodny mier a bezpecnost’ a
(d) vymenu informacif a skusenostf v otazkach strategickej obrany a bezpecnosti.
2. Ta.to Dohoda stanovuje ramec na posilnene partnerstvo a spolupracu v oblasti obrany a bezpecnosti medzi Spojenymi statmi a Slovenskou republikou a dopina vseobecne podrnienky stanovene v NATO SOFA, pokial’ ide o pritomnost’ ozbrojenych sil USA a ich zavislych osob nachadzajucich sa na uzemi Slovenskej republiky, ako aj pritomnost’ a cinnosti dodavatel’ov USA nachadzajucich sa na uzemi Slovenskej republiky v osobitnych situaciach uvedenych v tejto
Dohode.
3. Strany alebo ich vykonnf zastupcovia konzultuju podl’a potreby, najmenej vsak raz za rok, s ciel’om zarucit’ riadne vykonavanie tejto Dohody, a to vratane podrobnosti o cinnostiach ozbrojenych sil USA na uzemf Slovenskej republiky. Vykonni zastupcovia vypracuju postupy na konzultacie medzi svojimi prislusnymi zastupcami o vsetkych zalezitostiach tykajucich sa ucinneho vykonavania tejto Dohody. Strany alebo ich vykonni zastupcovia mozu podl’a potreby uzavriet’ vykonavacie dohody alebo dojednania na vykonanie ustanoveni tejto Dohody.
CLANOK2 DEFINICIE
Na ucely tejto Dohody sa vymedzuju nasledujuce pojmy:
1. Pojem ,,Ozbrojene sily USA” zahfiia silovu a civilnu zlozku, ako aj cely majetok, uradne informacie USA, vybavenie a material (vratane vozidiel, plavidiel a lietadiel prevadzkovanych Spojenymi statmi alebo pre Spojene staty) ozbrojenych sil USA nachadzajuci sa na uzemi Slovenskej republiky.
2 . Pojem ,,Ozbrojene sily” ma rovnaky vyznam ako je uvedeny v clanku I odseku 1 pism. a) NATO SOFA.
3. S vynimkou ustanoveni clanku 15 tejto Dohody, ma pojem ,,civilna zlozka” rovnaky vyznam ako je uvedeny v clanku I odseku 1 pism. b) NATO SOFA, a zahma tiez: a) zamestnancov neslovenskych nekomercnych organizacii, ktori su statnymi prislusnikmi Spojenych statov americkych alebo maju obvykly pobyt na uzemi Spojenych statov a ktori nemaju obvykly pobyt na uzemi Slovenskej republiky, a ktori vylucne s ciel’om prispiet’ k blahu, moralke alebo vzdelavaniu ozbrojenych sil USA sprevadzaju tieto ozbrojene sily na uzemi Slovenskej republiky; ab) zavisle osoby zamestnane ozbrojenymi silami USA, a to aj na ucely cinnosti vojenskej sluzby uvedenych v clankoch 21 a 22 tejto Dohody, ako aj zavisle osoby zamestnane nekomercnymi organizaciami uvedenymi v tomto odseku.
4. Pojem ,,Dodavatelia USA” zahfiia neslovenske fyzicke osoby ako aj neslovenske pravnicke osoby a ich zamestnancov, ktori nie su statnymi prislusnikmi Slovenskej republiky a su zmluvnymi dodavatel’mi alebo subdodavatel’mi Ministerstva obrany USA.
5. Pojem ,,Zavisla osoba” ma rovnaky vyznam ako je uvedeny v clanku I odseku 1 pism. c) NATO SOFA a zahfiia aj rodinneho prislusnika clena ozbrojen)1ch sit alebo civilnej zlozky, ktory a) je financne, pravne alebo zo zdravotnych d6vodov odkazany na podporu tohto clena; b) tvori
s tymto clenom spolocnu domacnost’ a c) nachadza sa na uzemi Slovenskej republiky so suhlasom organov ozbrojenych sil.
6. Pojem ,,Dohodnute zariadenia a priestory” zahfiia zariadenia a priestory na uzemi Slovenskej republiky uvedene v prilohe A k tejto Dohode a take d’alsie zariadenia a priestory na uzemi Slovenskej republiky, ktore maze Slovenska republika poskytnut’ v buducnosti na zaklade vzajomnej dohody, a ku ktorym maju ozbrojene sily USA, dodavatelia USA, zavisle osoby a d’alsie osoby podl’a vzajomnej dohody pristup a su opravnene ich pouzivat’ podl’a tej to Dohody. Pri plnom respektovani tych casti, ktore si Slovenska republika alebo jeho vykonny zastupca urci na svoje vyhradne pouzivanie, budu mat’ Strany spolocny pristup k dohodnutym zariadeniam
a priestorom a budu ich spolocne pouzivat’, s vynimkou tych casti, ktore Strany alebo ich vykonnf zastupcovia osobitne vyhradia na vyhradny pristup a pouzivanie ozbrojenymi silami USA
7. Pojem ,,Vykonny zastupca” zahrna Ministerstvo obrany Slovenskej republiky pre Slovensku republiku a Ministerstvo obrany USA pre Spojene staty, alebo ich poverenych zastupcov.
8. Pojem ,,Uradne informacie USA” zahma informacie, ktore SU VO vlastnictve Spojenych statov, sl’.1 vyrobene pre Spojene staty alebo Spojenymi statmi alebo podliehaju kontrole Spojenych statov.

PRISTUP K DOHODNUTYM ZARIADENIAM A PRIESTOROM A ICH VYUZiVANIE
1. Pri plnom respektovani suverenity a zakonov Slovenskej republiky su ozbrojene sily USA opravnene operacne riadit’ dohodnute zariadenia a priestory na ucely pristupu a pouzivania ozbrojenymi silami USA, dodavatel’mi USA, zavislymi osobami a inymi podl’a vzajomnej dohody na navstevy, vycvik, cvicenia, manevre, tranzit, podporne a suvisiace cinnosti, doplnanie paliva do lietadiel, tankovanie plavidiel, pristatie a predletovu pripravu lietadiel, docasnu udrzbu vozidiel, plavidiel a lietadiel, ubytovanie personalu, spojenie, rozmiestnovanie sil a materialu, predsunute rozmiestnovanie zariadeni, zasob a materialu, cinnosti v oblasti bezpecnostnej pomoci a spoluprace, spolocne a kombinovane vycvikove cinnosti, humanitarne cinnosti a cinnosti suvisiace s odstranovanfm nasledkov katastrof, operacie krfzoveho manazmentu, vystavbu na podporu vzajomne dohodnutych cinnosti a na ine ucely, na ktorych sa Strany alebo ich vykonnf zastupcovia mozu dohodnut’, vratane tych, ktore sa vykonavaj(1 v ramci Severoatlantickej zmluvy.
2. Na podporu tychto cinnosti a ucelov Slovenska republika opravnuje ozbrojene sily USA vykonavat’ kontrolu vstupu do dohodnutych zariadeni a priestorov alebo ich casti, ktore boli poskytnute na vyhradne pouzitie ozbrojenymi silami USA, a koordinovat’ vstup so slovenskymi organmi do dohodnutych zariadeni a priestorov spolocne pouzivanych ozbrojenymi silami USA a Ozbrojenymi silami SR na ucely bezpecnosti a ochrany. Vykonni zastupcovia stanovia postupy spoluprace tykajuce sa prevadzkovych a bezpecnostnych opatreni na vstup do dohodnutych zariadenf a oblastf.
3. Slovenskyvykonnyzastupcanaziadost’sprostredkujezabezpeceniedocasnehopristupua pouzitia zo strany ozbrojenych sil USA a dodavatel’ov USA:
(a) verejnych pozemkov a zariadeni (vratane ciest, pristavov a letisk), ktore nie su sucast’ou dohodnuteho zariadenia a priestoru, vratane tych, ktore su vo vlastnictve alebo pod kontrolou Slovenska, miestnych samospravnych krajov alebo miestnych samosprav a
(b) sukromnych pozemkov a zariadeni (vratane ciest, pristavov a letisk) na pouzitie na podporu ozbrojenych sil USA.
Toto sprostredkovanie sa vykona bez toho, aby ozbrojenym silam USA alebo dodavatel’om USA vznikli naklady.
4. Pri sprfstupnovani dohodnutych zariadeni a priestorov a pri pouzfvani tychto dohodnutych zariadeni a priestorov Strany nalezite zohl’adnia prevadzkove a bezpecnostne problemy.
5. Slovenska republika poskytne, bez najomneho alebo podobnych nakladov pre ozbrojene sily USA, vsetky dohodnute zariadenia a priestory vratane tych, ktore spolocne pouzivaju ozbrojene sily USA a Ozbrojene sily SR.
6. V koordinacii so slovenskym vykonnym zastupcom m6:zu ozbrojene sily USA a dodavatelia USA vykonavat’ stavebne cinnosti na dohodnutych zariadeniach a priestoroch a robit’ na nich zmeny a zlepsenia na podporu cinnosti a ucelov uvedenych v odseku 1 tohto clanku. Ozbrojene
sily USA budu spolupracovat’ so slovenskym vykonnym zastupcom v otazkach tykajucich sa takejto vystavby, zmien a vylepseni na zaklade spolocneho zameru Stran, aby technicke poziadavky a stavebne normy vsetkych takychto projektov realizovanych ozbrojenymi silami USA alebo v ich mene boli v sulade s poziadavkami a normami oboch Strim. Na tento ucel sa bude tento odsek vykonavat’ v sulade so vzajomne stanovenymi postupmi, v pripade potreby stanovenych aj vo vykonavacich dojednaniach. Ozbrojene sily USA mozu vykonavat’ takuto vystavbu, zmeny a zlepsenia s prislusnikmi ozbrojenych sil.
7. Ozbrojene sily USA zodpovedaju za naklady na vystavbu a rozvoj dohodnutych zariadeni a priestorov poskytovanych vylucne na pouzitie ozbrojenymi silami USA a za naklady na ich prevadzku a udrzbu, pokial’ n ie j e vzajomne stanovene inak.
8. Strany su na zaklade proporcionalneho pouzitia zodpovedne za naklady na vystavbu a rozvoj a naklady na prevadzku a udrzbu dohodnutych zariadeni a priestorov urcenych na spolocne pouzivanie alebo inak spolocne pouzivanych ozbrojenymi silami USA a Slovenska, pokial’ nie je vzajomne urcene inak.
9. Financovanie stavebnych projektov realizovanych ozbrojenymi silami USA musi byt’ v sulade so zakonmi a predpismi USA.
l0. SlovenskyvykonnyzastupcapodporiusilieozbrojenychsilUSAvtychtorealizaciach ziskanim potrebnych slovenskych opravneni a povoleni na takuto vystavbu, zmeny a zlepsenia, ktore sa realizuju zo strany ozbrojenych sil USA alebo v ich mene. Ozbrojene sily USA alebo dodavatelia USA poskytnu na poziadanie slovenskeho vykonneho zastupcu vsetku relevantnu, potrebnu a uvol’nitel’nu dokumentaciu na ziskanie tychto opravneni a povoleni. Tieto opravnenia a povolenia sa vydaju bez toho, aby ozbrojenym silam USA alebo dodavatel’om USA vznikli naklady.
11. Strany alebo ich vykonni zastupcovia v pripade potreby spolupracuju pri planovani vyuzivania a rozvoja dohodnutych zariadeni a priestorov, ako aj priestorov v okoli dohodnutych zariadeni a priestorov s ciel’om zarucit’ dlhodobe vykonavanie tejto Dohody.

PREDSUNUTE ROZMIESTNENIE OBRANNYCH ZARIADENi, ZASOB A MATERIA.LU
1. Pri plnom respektovani suverenity a zakonov Slovenskej republiky mozu ozbrojene sily USA prepravovat’, rozmiestnovat’ a skladovat’ obranne zariadenia, zasoby a material (d’alej len ,,rozmiestneny material”) v dohodnutych zariadeniach a priestoroch a na inych miestach podl’a vzajomnej dohody. Strany alebo ich vykonni zastupcovia konzultuju cinnosti podl’a tohto clanku v potrebnom rozsahu.
2. OzbrojenesilyUSAvopredinfonnujuslovenskehovykonnehozastupcuotypoch, mnozstvach a harmonogramoch dodavok tohto rozmiestneneho materialu, ktory maju ozbrojene sily USA v umysle prepravit’ alebo rozmiestnit’ na uzemi Slovenskej republiky, ako aj o dodavatel’och USA, ktori taketo dodavky uskutociiuju.
3. Rozmiestneny material ozbrojenych sil USA a zariadenia alebo ich casti urcene na skladovanie takehoto rozmiestneneho materialu budu vyuzite vylucne na pouzitie ozbrojenymi silami USA. Ozbrojene sily USA budu mat’ vylucnu kontrolu nad pristupom k takemuto rozmiestnenemu materialu, jeho pouzivanim a nakladanim s nim a budu mat’ neobmedzene pravo kedykol’vek takyto rozmiestneny material vyviezt’ z uzemia Slovenskej republiky.
4. Ozbrojene sily USA a dodavatelia USA budu operacne riadit’ skladovacie zariadenia uvedene v odseku 1 tohto clanku v zalezitostiach tykajucich sa rozmiestnenia a skladovania rozmiestneneho materialu vratane dodania, spravy, kontroly, pouzivania, udrzby a vyvezenia takehoto rozmiestneneho materialu. Lietadla, vozidla a plavidla prevadzkovane ozbrojenymi silami USA alebo pre ne, maju pristup na letiska a vnutrozemske pristavy Slovenska a na d’alsie miesta podl’a dohody na ucely dodania, skladovania a udrzby rozmiestneneho materialu ozbrojenych sit USA na uzemf Slovenskej republiky a jeho vyvezenia z uzemia Slovenskej republi ky.
CLA.NOK 5 VLASTNICTVO NEHNUTEBNOSTi
I. Vsetky budovy, nepremiestnitel’ne stavby a montovane sustavy postavene na pozemku v dohodnutych zariadeniach a priestoroch, vratane stavieb zmenenych alebo zlepsenych ozbrojenymi silami USA, zostanu vo vlastnictve Slovenskej republiky. Vsetky tieto budovy, stavby a sustavy postavene ozbrojenymi silami USA sa stanu vlastnictvom Slovenska bezprostredne po ich postaveni, no budu pouzivane ozbrojenymi silami USA, pokym ich tie budu potrebovat’.
2. Ozbrojene sily USA vratia ako vyhradny a nezat’azeny majetok Slovenska akekol’vek dohodnute zariadenie alebo priestor alebo akukol’vek ich cast’ vratane budov, nepremiestnitel’nych stavieb a montovanych sustav postavenych ozbrojenymi silami USA, hned’ ako ich ozbrojene sily USA prestanu.pouzivat’, a v pripade, ze Spojenym statom tym nevzniknu :iiadne naklady. 1. Vzhl’adom na to, ze Slovenska republika nesie celkovu zodpovednost’ za bezpecnost’ na svojom uzemi, prijme opatrenia potrebne na zaistenie ochrany, bezpecnosti a zabezpecenia ozbrojenych sil USA, dodavatel’ov USA, zavislych osob a rozmiestneneho materialu a na ochranu a zabezpecenie uradnych informacii USA. Na podporu tejto zodpovednosti budu ozbrojene sily Slovenskej republiky a USA uzko spolupracovat’ na zaruceni bezpecnosti a ochrany.
2. Ozbrojene sily USA su opravnene vykonavat’ vsetky prava a pravomoci nevyhnutne pre operacne riadenie ozbrojenymi silami USA na ucel ich pristupu a vyuzivania dohodnutych zariadeni a priestorov vratane prijimania vhodnych opatreni na obranu, udrzanie alebo obnovenie poriadku a na ochranu ozbrojenych sil USA, dodavatel’ov USA a zavislych osob. Spojene staty by mali koordinovat’ tieto opatrenia a vzdy koordinuju plany ochrany sil s prislusnymi slovenskymi organmi.

3. Ozbrojene sily USA, dodavatelia USA a zavisle osoby su vynate z predpisov upravujucich registraciu a kontrolu cudzincov. Ich pobyt na uzemi Slovenskej republiky sa povazuje za prechodny pobyt. Na ziadost’ organov ozbrojenych sfl USA vydaju slovenske organy tymto osobam bezplatne potvrdenie o pobyte.
4. Ak prislusnik ozbrojenych sil USA zomrie alebo opusti uzernie Slovenskej republiky pri presune, bude sa zavislym osobam tohto prislusnika nad’alej priznavat’ statut zavislych osob podl’a tejto Dohody po dobu devat’desiatich (90) dni po takomto umrti alebo presune. Ak su nezaopatrene deti zapisane do vzdelavacich zariadeni na uzemf Slovenskej republiky pred umrtim alebo presunom prislusnika, bude sa zavislym osobam nad’alej priznavat’ statut zavislych osob najmenej po dobu tridsiatich (30) kalendarnych dni po skonceni skolskeho roka alebo ukoncenia zapisu.
CLA.NOK8 LOGISTICKA. PODPORA
1. Slovenska republika na ziadost’ ozbrojenych sil USA vynalozi maximalne usilie, zohl’adiiujuc svoje vnutrostatne poziadavky a dostupne kapacity, pri poskytnuti logistickej podpory na vykonavanie cinnosti podl’a tejto Dohody.
2. Podl’a potreby sa takato logisticka podpora poskytne a preplati v sulade s dohodou ACSA alebo nastupnickymi dohodami.
3. V pripade logistickej podpory, na ktoru sa nevzt’ahuje odsek 2 tohto clanku, uhradia ozbrojene sily USA a dodavatelia USA primerane naklady za pozadovanu a prijatu logisticku podporu. V tejto suvislosti poskytne Slovenska republika ozbrojenym silam USA rovnako vyhodne podmienky, ako poskytuje Ozbrojenym silam SR, oslobodene od dani, poplatkov alebo podobnych uhrad v sulade so v:zajornne stanovenymi postupmi.
CLA.NOK9 MOTOROVE VOZIDLA.
1. Slovenske organy budu uznavat’ registraciu a udel’ovanie preukazov vojenskymi a civilnymi organmi USA na motorove vozidla a privesy ozbrojenych sil USA, ktore su v osobnom vlastnictve alebo prevadzke clenov ozbrojenych sil a ich civilneho personalu, dodavatel’ov USA a zavislych osob. Na ziadost’ organov ozbrojenych sil USA vydaju slovenske organy bezplatne poznavacie znacky pre sluzobne, netakticke vozidla a civilne poznavacie znacky, ktore sa nebudu odlisovat’ od poznavacich znaciek vydanych slovenskym obyvatel’om, pre sukromne motorove vozidla prislusnikov ozbrojenych sil, dodavatel’ov USA a zavisle osoby. Registraciu a postup pri vydavani preukazov zo strany Slovenska podl’a tohto odseku vykona Vojenska policia Slovenskej republiky v sulade s postupmi vzajomne stanovenymi vykonnymi zastupcami. Tieto vzajomne dohodnute postupy sa premietnu v smernici pre Vojensku policiu Slovenskej republiky.
2. Organy ozbrojenych sil USA prijmu primerane bezpecnostne opatrenia vo vzt’ahu k motorovym vozidlam a privesom, ktore registrovali alebo povolili alebo ktore pouzfvaju ozbrojene sily USA na l’.1zemi Slovenskej republiky.

2. Lietadla prevadzkovane ozbrojenymi silami USA alebo vylucne pre ne maju pravo preletu, pravo vykonavat’ tankovanie pocas letu, pristavat’ a vzlietat’ na uzemi Slovenska. Tieto lietadla su oslobodene od odplat za poskytovanie leteckych navigacnych sluzieb vratane trat’ovych odplat a terminalnych odplat. Okrem toho tieto lietadla su oslobodene od letiskovych odplat vratane odplat za pristatie, odplat za parkovanie a odplat za sluzby pre cestujucich na letiskach VO vlastnictve statu a prevadzkovanych prislusnym organom statnej spnivy na uzemi Slovenskej republiky .
3. Ozbrojene sily USA a dodavatelia USA vykonavajuci cinnosti v mene ozbrojenych sfl USA zaplatia za pozadovane a prijate sluzby primerane odplaty vo vyske, ktora nie je menej vyhodna ako pre Ozbrojene sily SR, oslobodena od dani a podobnych poplatkov.

I. Slovenska republika uznava osobitnu dolezitost’ disciplinarnej kontroly ozbrojenych sil USA nadjej prislusnikrni a vplyv, ktory ma taka kontrola na operacnu pripravenost’. Slovenska republika preto na ziadost’ Spojenych statov a na podporu svojho zavazku o vzajomnej obrane tymto uplatftuje svoju suverennu diskrecnu pravomoc vzdat’ sa svojho prednostneho prava na vykon trestnej pravomoci podl’a clanku VII odseku 3 pism. c) NA TO SOFA. V konkretnych pripadoch trestnych cinov, ktore maju pre Slovensku republiku osobitny vyznam, mozu slovenske organy toto vzdanie sa pravomoci odvolat’, a to pisomnym vyhlasenim, ktore sa predklada prislusnemu organu ozbrojenych sil USA najneskor do tridsiatich (30) dni od prijatia oznamenia uvedeneho v odseku 2 tohto clanku. Slovenske organy mozu predlozit’ vyhlasenie aj pred prijatim tohto oznamenia.
2. Ozbrojene sily USA oznamia slovenskym organom kazdy pripad podl’a odseku 1 tohto clanku, s vynimkou trestnych cinov, za ktore mozno ulozit’ pokutu alebo trest odiiatia slobody na menej ako (3) tri roky.
3. Kedykol’vekje prislusnik ozbrojenych sil USA alebo zavisla osoba stihana slovenskymi organrni, trestnu pravomoc vykonavaju slovenske vseobecne sudy.
4. Prislusnici ozbrojenych sil USA a zavisle osoby nebudu sudene v nepritomnosti bez ich suhlasu, ibaze sa neopravnene vyhybaju povinnosti dostavit’ sa pred sud napriek riadne prijatemu oznameniu o datume pojednavania alebo pokial’ sa nezakonne vyhybaju posobnosti organov ozbrojenych sil USA.

2. Prislusnik ozbrojenych sil USA alebo zavisla osoba, ktoru slovenske organy vysetruju, alebo sa voci nej vedie sudne konanie, zotrva alebo bude umiestnena pod kontrolu organov ozbrojenych sfl USA, ak o to tieto organy poziadajt1, az do ukoncenia vsetkych suvisiacich sudnych konani (vratane odvolacieho konania). 3. Doba obmedzenia osobnej slobody slovenskymi organrni alebo doba vazby organmi ozbrojenych sil USA sa zapocita do trestu odiiatia slobody, ak bude v predmetnej veci ulozeny.

Pokial’ sa Strany nedohodnu inak, odiiatie slobody ulozene slovenskym sudom prfslusnikovi ozbrojenych sil USA alebo zavislej osobe sa vykona v jednom alebo viacerych slovenskych napravnych zariadeniach urcenych Stranami na tieto ucely. Slovenske organy povolia ozbrojenym silam USA navstivit’ tieto osoby mimo beznych navstevnych hodin a umoznia im poskytnut’ tymto osobam pomoc vratane starostlivosti o zdravie, blaho a moralku, vo forme oblecenia, jedla, postel’nej bielizne, lekarskej a zubnej starostlivosti a nabozenskeho poradenstva. 2. Oslobodenie od dane sa uplatiiuje na nadobudnutia uvedene v odseku I tohto clanku v sulade so vzajomne urcenymi postupmi, ktore su stanovene vo vykonavacom dojednani. Oslobodenie od dane sa uplatni v mieste nakupu, pokial’ je k transakcii prilozene prislusne osvedcenie uvedene
v odseku 1 tohto clanku. V o vsetkych ostatnych pripadoch, alebo v pripade, ze predajca nemoze poskytnut’ taketo priame oslobodenie od dane, sa oslobodenie realizuje prostrednictvom vratenia <lane do tridsiatich (30) dni od prijatia ziadosti.

3. Ustanovenia slovenskych zakonov a predpisov vzt’ahujuce sa na povinnost’ zamestnavatel’a alebo samostatne zarobkovo cinnej osoby zrazit’ dan alebo odvadzat’ preddavky na dan z prfjmov alebo prispevky na socialne poistenie sa nevzt’ahuju na prijem oslobodeny od dane na uzemi Slovenskej republiky.

Takyto dovoz bude oslobodeny od cla, dovoznych alebo registracnych poplatkov a inych podobnych poplatkov, okrem ineho aj od dani z pouzivania, spotrebnych dani a DPH.
2. Stranypodl’apotrebyspolupracuju,abysaubezpecili,zemnozstvodovezenehomaterialu, zasob, vybavenia a ineho majetku je primerane. Predlozenie osvedcenia sa akceptuje namiesto colnej kontroly zo strany slovenskych organov na polozky dovezene a vyvezene ozbrojenymi silami USA alebo pre ne podl’a tohto clanku. Pokial’ dodavatelia dovazaju material, zasoby, vybavenie a iny majetok podl’a ustanoveni tohto clanku, ozbrojene sily USA musia vyzadovat’, aby dodavatelia pouzivali polozky vylucne na plnenie zmluv ozbrojenych sil USA.

Prislusnici ozbrojenych sil USA, zavisle osoby a dodavatelia USA mofo dovafat’ svoje osobne veci, nabytok, jedno (1) sukromne motorove vozidlo na osobu starsiu ako osemnast’ (18) rokov a d’alsi tovar, okrem strelnych zbrani, urceny na ich osobne alebo domace pouzitie alebo spotrebu bez cla a dani pocas ich pridelenia na uzemie Slovenskej republiky. Tato vysada sa vzt’ahuje nielen na tovar, ktory je majetkom tychto osob, ale aj na tovar, ktory im darovali alebo dodali pri plneni zmluv uzavretych s osobami, ktore nemaju pobyt na uzemi Slovenska. Taketo dovozy nesmu prekrocit’ primerane mnozstvo pre osobne pouzitie a nesmu zo svojej povahy alebo mnozstva vyvolavat’ dojem, ze su dovezene na obchodne ucely. Tovar uvedeny v odseku 1 tohto clanku a iny tovar nadobudnuty bez danf a/alebo cla nemozno predat’ ani inak previest’ osobam na uzemi Slovenskej republiky, ktore nie su opravnene dovazat’ takyto tovar bez cla, ak takyto prevod neschvalia prislusne slovenske organy. jednotlivca alebo v sulade so vzajomne stanovenymi postupmi.
3. InformacieozbrojenychsflUSAutajovanejpovahyjemoznedoviezt’nauzemieSlovenskej republiky a vyviezt’ z uzemia Slovenskej republiky bez toho, aby podliehali colnej kontrole. ,,Informacie utajovanej povahy” maju vyznam stanoveny v Dohode o informacnej bezpecnosti a bude sa s nimi zaobchadzat’ v sulade s nou alebo s jej nastupnickymi dohodami.
4. Ozbrojene sily USA zavedu v zariadeniach, v ktorych sa nachadzaju ozbrojene sily USA, potrebne opatrenia na zabranenie zneuzivaniu prav udelenych podl’a colnych ustanoveni NATO SOFA a tejto Dohody. Ozbrojene sily USA a slovenske organy spolupracuju pri vysetrovani akehokol’vek udajneho porusenia colnych predpisov.

CINNOSTI V OBLASTI VOJENSKEJ SLUZBY
1. Ozbrojene sily USA m6zu na uzemi Slovenskej republiky na vzajomne dohodnutych miestach zriadit’ vojenske sluzobne predajne, predajne potravin a ine predajne, otvorit’ stravovacie zariadenia, spolocenske a vzdelavacie centra a sluzobne rekreacne priestory na vyuzivanie prislusnikmi ozbrojenych sil USA, zavislymi osobami a inym opravnenym personalom podl’a vzajomnej dohody. 2. Ozbrojene sily USA mozu uzavriet’ zmluvy s financnymi instituciami na prevadzkovanie bankovych a inych financnych cinnosti na uzemi Slovenska na vyhradne pouzitie ozbrojenymi silami USA, dodavatel’mi USA a zavislymi osobami.
3. Na cinnosti a organizacie uvedene v tomto clanku Sa vzt’ahuju rovnake daifove a colne vynimky, ake sa udel’uju ozbrojenym silam USA. Tieto cinnosti a organizacie sa udrziavaju a prevadzkuju v sulade s platnymi predpismi USA. Od tychto cinnosti a organizacii sa nevyzaduje, aby vyberali alebo platili dane alebo ine poplatky za cinnosti suvisiace s ich prevadzkou.

Naklady ozbrojenych sil USA sa budu rovnat’ ich pornernemu podielu na vyuzfvanf tychto verejnych sluzieb.
2. Osobne vyuzfvanie sluzieb spravy kornunalneho odpadu prislusnfkrni ozbrojenych USA, ich zavislych osob a dodavatel’ov USA podlieha prevladajucim poplatkom za tieto sluzby stanovenych prislusnymi slovenskyrni organmi.
3. Strany uznavaju, ze pre ozbrojene sily USA moze byt’ nevyhnutne pouzfvat’ radiove spektrum. Spojene staty mozu prevadzkovat’ svoje vlastne telekomunikacne systemy (podl’a definicie pojmu ,,telekomunikacia” v Ustave, ako aj v Dohovore Medzinarodnej telekomunikacnej unie z roku
1992). To zahrna pravo pouzfvat’ take prostriedky a sluzby, ktore su potrebne na zarucenie uplnej schopnosti prevadzkovat’ telekomunikacne systemy, a pravo pouzfvat’ na tento ucel nevyhnutne radiove spektrum v sulade s poziadavkami na koordinaciu uvedenymi v odseku 4 tohto clanku. Pouzfvanie radioveho spektraje pre Spojene staty bezplatne.
4. Ozbrojene sily USA v zaujrne zabranenia vzajomneho rusenia vynalozia vsetko primerane usilie na koordinaciu vyuzfvania radioveho spektra s prislusnymi slovenskymi organmi, pricom zohl’adnia narodnu tabul’ku frekvencneho spektra.

3. Spory a ine otazky, ktore podliehaju konzultaciam v zmysle tejto Dohody, sa nepredlozia ziadnemu vnutrostatnemu sudu ani ziadnemu medzinarodnemu sudu, tribunalu alebo podobnemu organu, ani ziadnej inej tretej strane.

I. Ta.to Dohoda nadobuda platnost’ prvym (1.) d110m druheho (2.) mesiaca nasledujuceho po datume neskorsej n6ty, v ktorej si Strany navzajom diplomatickou cestou oznamia splnenie svojich vnutrostatnych pravnych postupov potrebnych na nadobudnutie platnosti tejto Dohody.

For 75 år siden i fjor sommer, inngikk USA og Estland diplomatiske forbindelser, og startet dermed et spesielt forhold basert på gjensidig respekt og tillit. Det er et gammelt ordtak som sier at man gjenkjenner en sann venn i tider med nød. Med sin todelte støtte til ikke-anerkjennelsespolitikk var Amerika en sann venn av Baltikum i en tid med nød, og fungerte som et fyrtårn av håp gjennom de lange, mørke og kalde årene av den sovjetiske okkupasjonen.
